Couple jailed after waiting three days to take baby with 'hanging' broken arm to hospital

A couple left a baby with a broken arm in ‘significant pain’ for three days before finally taking him to hospital.

Gemma Warne, the five-month-old baby’s mother and her now ex-boyfriend Lee Chambers have both been jailed for four months.

The couple admitted they did not take the child to A&E even though they were explicitly told to do so by their GP on August 14 2015.

Jailing them at Grimsby Crown Court, Judge Mark Bury said: ‘There was significant pain and suffering to the baby which could have been avoided.

‘You were both told by the GP the baby needed immediate care at hospital and you were both advised to take him to accident and emergency.

‘Your failure to do so was unforgivable. He depended entirely upon you for his health and well-being and you both let him down badly.’

Craig Lowe, prosecuting, said Warne, 29, and 37-year-old Chambers took the baby to the doctors after he began crying when he was picked up and when his shoulder was touched.

Both Warne, formerly of Hainton Avenue, Grimsby and Chambers, of Abbey Road, Ulceby, claimed they were told to monitor the arm rather than take further action.

The injury was caused accidentally, but the baby suffered until the couple took him to Diana, Princess of Wales Hospital in Grimsby, Lincolnshire, on August 17, when they noticed his arm was ‘hanging’.

The child is now in long-term foster care.

Warne’s own barrister Charlotte Baines admitted that her parenting skills were ‘inadequate’.

She said: ‘They took the baby to Immingham Medical Centre because at that time the doctor’s surgery was not due to open until the afternoon.

‘The medical centre told them they could not deal with the baby because he was under six months old and advised them to see their GP and they did do that.

‘They didn’t go to hospital because they did not hear what the GP had said to them about going to accident and emergency for an x-ray.’

Miss Baines said it was clear Warne, who suffers with depression and anxiety and had a heroin addiction for several years, has ‘inadequate’ parenting skills.

Katherine Goddard, mitigating for Chambers, said he did not hear the advice given to him by the GP.
