A man punched another man and claimed he sexually assaulted him after receiving a consensual blow job.

Stoke-on-Trent Crown Court heard how Jed Wheatley, 32, threw the mans trousers out the fire escape of his Staffordshire flat and then hit him in the face without warning.

Prosecutor Richard McConaghy said: The injured party was very drunk indeed. While at the flat he performed oral sex on the defendant. It was a consensual act.

The defendant left the room and then came back and told the injured party he knew a lot of people and as far as he was concerned he had just been sexually assaulted.

He decided he wanted the other man to leave. He threw the mans trousers on the fire escape. The man went out, put his trousers on and headed down the fire escape to leave.

He added that Wheatley, who met the victim at a Hanley nightclub, told him he couldnt exit the premises and to come back up to the flat.

Wheatley then punched him once to the face with a clenched fist.

Mr McConaghy added: The man grabbed the defendants wrist in order to stop it happening for a second time and turned and ran into Hanley town centre.

He felt he was being followed by the defendant. By the time he found his way to a police officer he was not being pursued.

The officer described him as crying. He took him on a drive around the area and he eventually identified the building and the defendant was arrested.

Weathley, of Hanley, Staffordshire, who was subject to a suspended sentence at the time for a robbery, has been sentenced to a 12-month community order with 60 hours
unpaid work.

He has denied assault, but was convicted after a trial by North Staffordshire magistrates.

Recorder Stephen Thomas told Wheatley: At a time of stress you seem to have punched him as he was seeking to leave. I think it is highly unlikely if you come before this court again you will get the same lenient treatment.

Robert Smith, mitigating, said it was a bizarre and unusual offence.

Mr Smith added: His head was all over the place. He went out to try to clear his mind and put the difficulties out his mind.

Was this sexual experimentation gone wrong? Was it a case of confusion, guilt about his sexuality and his exploration? We will never know.

He said the defendant used to live at the Macari Centre but moved on from there in July but he still volunteers his time for the homeless.
